How long does the probate process typically take in Malaysia?

Timelines vary based on estate complexity and court scheduling. In straightforward matters, a Grant of Probate may be obtained within four to eight months. Where the estate involves multiple asset classes, creditor claims, or disputes, proceedings may extend beyond a year. We provide realistic timeframe estimates at the outset of each matter.

Is a will required to apply for probate?

A Grant of Probate is applied for when there is a valid will, and the executor named in that will makes the application. Where no will exists, the estate is administered through a different process — a Grant of Letters of Administration — governed by the Distribution Act 1958. We advise on both pathways depending on the circumstances.

What documents should we gather before our first consultation?

It is helpful to bring the original will (if one exists), the deceased's identity documents, a list of known assets and financial accounts, property titles where available, and any recent statements from banks or investment firms. If not all documents are at hand, please come anyway — our team will advise on what to locate and in what order.

What are the professional fees, and when are they payable?

Our service fees are stated clearly upfront and agreed in writing before any work commences. The Estate Inventory Assessment is RM 2,250, Grant of Probate Processing is RM 5,600, and Beneficiary Rights Consultations are RM 1,200 per session. Court filing fees and disbursements are itemised separately. Payment terms are discussed and agreed with each client individually.

Can beneficiaries living overseas be represented?

Yes. We regularly work with beneficiaries based outside Malaysia. Consultations can be conducted via video call, and most documentation processes can be managed remotely through properly executed powers of attorney and notarised correspondence. We guide overseas-based clients through the requirements clearly at each step.

How is the estate inventory used in the probate process?

The estate inventory forms the factual foundation for probate proceedings. Courts require a comprehensive account of all assets and liabilities to administer distribution correctly. A methodical, well-prepared inventory reduces delays and the likelihood of queries from the court or creditors. It also provides beneficiaries with a clear picture of the estate's overall position.
